eBay pics usage question

I have a question to run by you guys.

I came across an eBay auction for Brand New's "Deja Entendu" and the seller used the pic I took of my record and uploaded to the Dead Format pressing info. In the description he states that the pic is of his personal copy as he is selling a sealed one.

What can be done about this? Is this allowed?

Here is the link to the auction: http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=280199827004

And what got me to double-check my pics were the bedsheets the records are on.

Battle Royale!

and, if he's labeling it as 'sealed', and it's his copy, how is he able to take pictures of the records themselves? I'm calling bullshit

He just means that he's got two copies of the record. The one pictured is his (not in this case though), and you get the same thing, only sealed.

A number of years ago (1999-2000, I think), I was selling a bunch of band stickers on eBay that I got from the record store I worked at. I would scan each one in individually, and sometimes little corners of them would get chopped off, so I'd always know exactly which images were mine. Whenever I saw someone steal my image for their own auction of the same item, I would just place a huge bid on it making sure no one else could win it. Then after I won, I'd write the seller and tell him he was a douche for stealing my images and that I wasn't paying.

Ah, the good ol' lawless days of eBay...
