  1. Derrek Lee. He played Little League with my little brother. My dad was the coach. Nicest kid ever. When he was a freshman in high school and I was a senior, he ended my run at first base and my baseball career.

  5. So you're saying implied trust = mandatory disclosure of sensitive information. Would that hold up in a court of law, Scott? Last I checked this was not a court of law. If people sued him for what he owed, then it would all be public. However, the independent music exists on trust and integrity. It's been that way for years. There is a long list of people who preyed on this, and left labels, bands and music lovers high and dry. Virgil is just another name on the list. If he wanted to be above board, he could easily state what is owed and his plan to pay it back. Instead he disappears, inconsistently responds to requests for $$$, and moves on to the next business. It's a common pattern for those of us who have seen it happen over and over again.

  7. Damn, that's your best zinger? That I posted about bandtoband? I didn't start the site. I found it, it ruled, and I got involved in the content and handled email submissions for years. There is a group of about 10 of us that work on the site regularly, but it was started by Kevin Finn (who built the Rev and Epitaph sites, I believe) and a guy named Mark Kennedy. At the time I posted over at that other board it looks like it was when I first found the site, and was not yet involved. Thank you for providing another example of blindly swinging at irrelevant stuff.

You want more insight? Fine, but please don't send me anymore vaguely threatening PMs. As usual, you are wrong on many different levels: 1. You think are smarter than you are. 2. You have issues with logical thought and end up firing in all directions, many times with thoughts that are non-responsive. 3. You are a constant Virgil apologist. 4. Dude was not looking for advice about a lawsuit, so your comment about an "iron-clad contract" was not relevant to the situation. 5. Virgil is a dick here, contract or no. 6. Although the law on contracts differs from state to state, there are some pretty uniform rules on what equals a contract. Being "iron clad" is not one of them. Contract require an offer, acceptance and consideration from both parties. In other words, Virgil offers X number of records and test presses in exchange for the right to release a song. Assuming the email about the test presses was sent prior to the song being sent in, then it is part of the offer. Sending the song in (performance) = acceptance. Consideration from Virgil to the band is X number of records and the test presses. Consideration from the band to Virgil is the song, and allowing Virgil to press copies and sell them. That means that there was a contract under the law. Whether or not the contract was breached is another story (how long does Virgil have to perform (i.e. send the test press to the band?) But you didn't talk about breach at all, only about the contract itself existing. The advantage to having a clearly written contract signed by both parties is that it is easier to prove a breach, but that is not a requirement for a valid contract.

  14. I actually didn't go to Maui when I was living out there. Went back with Mrs. Mean. But she was pregnant, so we didn't mountain bike. Sounded like fun, though.
  15. Lived on Kauai for a few months. On Maui, you have to drive the Hana Highway. Get a book that shows you where to stop. There are a good 20 or so different places to stop along the way with various cool things to see and do. You can also mountain bike down the volcano. For the flight, do whatever is cheapest. A connection through Honolulu won't add any significant time.
