His story said 10 copies were warped and the plant said he had to order 50 at a minimum.
 
In my experience, plants have you sign a contract that explains there can be a 10% overrun or under run. 
 
It is very possible that the 10 warped copies are within that 10% and per the contract, the plant could've just refunded him for those copies as they were still fulfilling their agreement. 
 
That being said, most labels know not to put every single copy ordered from the plant up for preorder in case there is an under run which happens all the time. 
 
If he was doing the right thing, he would've either refunded the ten people or order the 50 minimum of the SAME COLOR and ship out those 10 copies. The fact is, he got greedy and decided to make a secret variant of 50 in order to use for trading or selling on the side as a special, more limited variant.
 
Sure, he gave some to friends and helpers. He's a real nice guy.

This is crossing a line. It's one thing to many sin the discussion and fevered development here, but when it spills out into the outside of VC and borders on harassment, I take issue with that.
Surely it's already known that all of this is being talked about. Please do not harass the guy on his non-VC platforms. I don't need anything to come back on us here.

In the end, I don't think anything is going to change for ETR. Look at SRC. People get their pitchforks out once a week over that joke of a company, and all it takes for people to stop being angry is a goddamn Goldfinger reissue. If you ask me they are guilty of far worse crimes.

Why did all of you support this label until right now if this is all it takes for you turn your back on it? Are you really surprised a label who pretty much only reissues major label crap is doing under the table deals to make more money? They put out KoRn, Dream Theater, and Cartel records, and when they're not licensing from majors, they're paying Drive-Thru, one of the most fucked up labels of all time ran by literal lunatics, their money. Clearly there is nothing 'punk' or 'DIY' about it. It's simply a game of going through lists of records and finding stuff that either hasn't been pressed before, or is out of print, that you think you can sell ~500 copies of, and then talking to people. There is literally no culture or aesthetic. ETR doesn't stand for anything, and that's fine.
 
Ross clearly has every right to start and run a company of that nature, but to me, it has nothing to do with what I do or what other indie record labels do. None of this surprises me because of the nature of ETR's business. I honestly don't think most of the stuff you guys are calling him out on isn't ~that~ bad in the grand scheme of things (besides lying about it) but I also understand the witch hunt nature of this message board. If Deathwish or Topshelf or someone did the same thing, I would feel the same way most of you guys do, but that is because it would be completely out of character with how those companies operate.

I can't believe a company as big as Hot Topic is willing to do business with him. Seems like a poor idea.

Telling someone "don't show this to anyone" regarding a vinyl record is hilarious to me. 

If Ross was super smart, he would make sure everyone that did a grab bag got something super rare that people clamor over. That way word gets out that he did something cool and would sway some people back to his side. In reality, they will all get They Shot Flannigan records.

I just feel the need to chime in and say that unsold product doesn't consitute a loss for the IRS when filing taxes. In fact, your remaining inventory is how you calculate profit/loss for the fiscal year.
I won't go into details, but as long as he is claiming sales AND remaining inventory the tax situation would be cool. He would also have to claim all eBay sales as well though, since they are income (and would create extra profit for which taxes owed would increase)

This one was started in 1999 when we were in high school and has such a high feedback that neither of us wanted to give it up. 

I am off vc for a few days and come back to a shit storm.  Sorry, I have been mia but we had 3 releases go on sale last week and have been in the process of shipping out those orders. I checked vc a couple nights ago ago and didn’t see any of this.
 
To set the record straight. It is an account which a bunch of my friends and I have used since 1999 hence it having a pretty high positive feedback.  In the past some stuff for sale has been mine, some stuff has been my friends and some even my friends selling stuff for their parents(hence the meteorite up right now which I didn’t even know until someone pointed it out).  Regardless, in this particular case for the etr albums sold on that account recently, None of those were mine. They were one of my friend’s who is a semi active member of the board and already commented/ admit to it apparently the other day. The hrvrd cd/dvd up now is mine and I had a descendants xmas sweater up a couple months ago which didn’t sell.  It seems the same couple people clearly have issues with me, which is fine. Like I always say “Haters gonna hate”. Everyone is entitled to their opinion and to me knowledge those people never purchased records from me in the first place.  I hope that clears things up
 
On a more productive note: To update anyone who has placed orders through the webstore in the last two weeks. I have been in the process of packing everything up and have mailed out 300 out of 600 or so orders so far with another 50 being packed up tonight. Sorry to everyone for the delay and hope everyone had a happy new year

I had variants on the HRC and the Acceptance records. 

When the HRC records went up, shipping from Thunderbeard was cheaper, because our records always shipped for $3-4. He flipped out, accusing me of ruining a release that he had worked hard for 3 years on because I didn't price match him at $5 shipping, which is something we hadn't discussed. 

Ironically, I've been in talks with Ben about releasing YMAEWK - So Young So Insane ever since I released A Great Big Hole. I haven't been "working" on it for 3 years, but it took time to get the files from the engineer and coordinate a release date with Ben (finally happening after his EP is released this Spring). Ross went to Ben and told him he could source the release with a CD. Then he asked people on here and online for a used copy of the disc. 

He was going to source one of his releases with a used 7 year old CD, all while "ruining a release I had worked hard on for 3 years."

Oh, and I spoke with Nic from Cartel via e-mail a few times, and he had a different story than the sugarcoated ending that we all saw in the Chroma thread.

"Blues Traveler vinyl series" only 35 bucks a record!  Or you can buy 4 for only 120 bucks. A steal! This is what modern collector culture have started. Not to mention this makes up a good portion of what's clogging up the plants.
