Just file a claim. The guy is full of shit. He's avoiding your questions and trying to frame your request as if it was an arduous task. It's not. You're being the nice guy here trying to work things out, but he's the one who 
A. Still has your money
B. Still has your record (Since your money is still in his possession)
C. Is extremely difficult
D. Is screwing you and doesn't care
You have every reason to go forward with this. I sympathize because I was in a similar situation. Again, just go to paypal and do what I mentioned before. Just saying that the listing was false would win your dispute, but I'd go farther than that by detailing the whole ordeal to put the final nail in the coffin.
 
Vinyl records don't turn to dust... I have records twice my age and they didn't crumble like a cookie.

I have a similar story. Whenever I order a record, the carrier just places the package against my house, no problem. Now either someone else was doing the route my house is on, or the usual carrier is just on crack, but they literally shoved the 12" mailer inside of my small mailbox, that really only holds envelopes. Needless to say I was pretty upset. I actually still have the record, I'm assuming this caused the damage, the outer edge has a chip in it, but it doesn't effect the playing, but still why would ANYONE put a 12" mailer stuffed 1/3rd inside of a small mailbox?

I reuse mailers.
I do this.
Remove record from jacket, place everything in a sealable plastic sleeve. Tape everything to a sheet of card board. Tape another sheet of cardboard on the other side. Place in mailer and tape to center. Nothing will slide around.
Then tape cardboard over all four corners to prevent corner damage.

I love my HD 598s. Great quality for the price.
 
I think the Denon 1000s I had sounded better, but those are so fragile they broke and the wires shorted out.
The Denon's new model is made of crickety plastic, every turn of the head goes CREEEK.
Denon 5000s besides being expensive, will reveal too much sibilance for vinyl.
 
HD 598s take a long time to burn in. You can leave music running for a week before they start sounding good, but they do, its great.
 
However, they are open-eared, so it could be troubling for those around you.

I'll grant you that My Name Is Jonas is one of the greatest A1 tracks of all time, but Surf Wax America is almost certainly the best B1 ever.
 
Toss in Only In Dreams as the closing track, along with Say It Ain't So, Holiday, and In The Garage and you'd got one of the strongest B-sides I can possibly imagine.
