allenh
There’s a sucker born every minute. VNYL won't exist in a couples months and this dude will walk into the sunset with a shit load of cash he didn't earn and legally doesn't have to give back. Maybe he'll magically acquire a Jiminy Cricket like conscience and make things right with his "customers" but to what avail? So people on the Internet stop talking shit about him? Lol. A modern day snake oil salesmen! A true journeyman of the swindler craft! He'll eventually get some cushy job in marketing or something, a golf club membership, a coke habit. He'll die at the ripe old age of 45 from a stroke and will be survived by his plastic surgery savaged wife Becky and two horrible sons Trenton and Nick Jr. One will eventually be on the news because he lead an OU style racist chant on a bus with his fraternity brothers. The end. (We should Kickstart this story as a movie!) Makes me proud to have got to 46 without ever feeling the urge to pick up a golf bat. There's also the alternative ending involving a bag of Colombian marching powder, a porn actress, a Porsche and a strategically placed tree or the one involving massive debt, a yacht and the suspicious death with no body ever found and then him turning up in an African dictatorship with a new name and a suspicious moustache which finally ends with him in a cell with a new best friend called big Frank and not being able to sit down without a very soft cushion. This script could run and run
Shitty Rambo
I agree this petition is likely to have the practical effect of a fart but if inverstors were actually defrauded, they would have a legal claim for damages. Do we know for a fact he took investments outside of Kickstarter? If he only used funds accumulated through Kickstarter there is no legal recourse. Stuff gets funded and shit's the bed all the time. When you back something on Kickstarter you're basically taking a gamble, it's not a preorder platform. BobbyHill

So since there's no recourse for "investors", what keeps people from making majorly bogus claims of some type of service/product that they ultimately had no goal in achieving? Say that I started a kickstarter for a handheld 3D printer that sold for $20, got millions of backers, then said "nah, jk dawwwwwwg" and ran off with the money - is this not illegal? Because, if so, come fund my kickstarter!

_stretts
http://flyingvinyl.co.uk/ uh oh We believe that discovering the best new alternative music should be an intimate, personal experience that digital music cannot satisfy. That’s why we created Flying Vinyl, a company that sends its members a monthly box filled with the best new alternative music printed onto beautiful 7” vinyl records. We always send at least five fully packaged, high-quality records with two tracks from each artist, exclusively pressed to vinyl for our members. Our boxes also regularly include signed merchandise and other products for vinyl lovers.

allenh
http://flyingvinyl.co.uk/ uh oh I'm really starting to dislike the word curate, I heard it in a news piece about Apple radio where they spoke about curating music for output on their internet radio station. I could be way off here but isn't that particular service already covered by millions of Radio DJ's and producers the world over? The rest of the stuff they came out with for Apple music seemed utterly underwhelming and just a bit seen it all before as well. I did like the bit about changing music from just bits of info back to art though and thought Apple themselves had a lot to do with the reverse of that process to start with. Growing dislike of the word curate aside and apart from the gaping lack of info this one looks very much like the Too Pure singles club that I've been a member of for years although that one is £35 for the year and is one 7" a month whereas this one is £240 a year (£192 if you pay in one go) for a minimum of 60 7" singles a year, both supposedly send out work from alternative bands on 7" singles and I know what I'm getting with the Too Pure club and who it's parent label are but this one is a little light on info although possibly worth risking £20 for the first month, mind you if I do and I get 5 different charity shop 7" singles from the likes of Max Bygraves, Perry Como, Acker Bilk, Des O'Conner and Englebert Humperdink etc. etc. I might have the return them along with a flaming bag of poo for descriptive effect. When you back something on Kickstarter you're basically taking a gamble, it's not a preorder platform. My point was that even if he only solicited investments through Kickstarter, that doesn't insulate him from liabilty if he committed fraud. For example, if he used all the money from the VNYL kickstarter campaign to buy drugs, it would be no defense to say, "sorry, you took a gamble." The risk of business not working out =/= the risk of being defrauded.

If they issue refunds for this I'll eat my fuckin' hat or whatever. Goddammit (lol).

allenh
In other news I've signed up for the Flyingvinyl thing, I thought it worth the risk of £20 for 5 7" singles. I spoke to the guys that are doing it as I signed up after the first deadline and was asking if I could be included in the first delivery which they've included me in so I should get a package in a couple of weeks and will report back on what it contains. I'm open minded on it at the moment and am interested to see what arrives, I could have asked what bands were on the records as some people have done on Facebook and they have used PM's to tell people so it's not a secret but I thought I would wait and see what arrives. I'm loath to belabor this nerd discussion but I'm just talking about peoples' right to sue this guy if they can she they were defrauded (for example, if he spent all the money on hookers). A fraud claim would be based on state law and has nothing to do with kickstarter's refund policy.
